Terms of Service
These Terms of Service ("Terms") govern your use of the 59 Realtors website and platform ("Platform"), operated by Fifty Nine Realtors Private Limited ("we", "us", "our") under the brand name "59 Realtors." By creating an account or using the Platform, you agree to these Terms.
1. Eligibility and accounts
- You must be at least 18 years old and able to form a binding contract to use the Platform.
- You may create an account with Google Sign-In or with an email address and password. You are responsible for keeping your login credentials secure.
- You must provide accurate information, including a valid mobile number, when completing your profile.
2. What 59 Realtors does
59 Realtors is a platform that connects property buyers, sellers, and channel partners, and provides tools such as address verification, fair-value (TrueCost) estimates, and AI-assisted search/description features. We are not a party to any transaction between a buyer and seller; we do not guarantee any sale, price, or outcome.
3. Listings
- Sellers and partners are solely responsible for the accuracy of listing information, including price, ownership, and documents submitted.
- All listings are subject to review and may be verified, published, rejected, or have changes requested by our team before going live.
- A "Verified" badge indicates the listing passed our address/document checks at the time of review; it is not a guarantee of title, condition, or value.
- We may remove any listing that violates these Terms, applicable law, or contains fraudulent or misleading information.
4. Buyer & seller conduct
By expressing interest in a listing, you consent to your contact details being shared with the relevant seller, partner, or our team to facilitate the enquiry. You agree not to use contact details obtained through the Platform for unsolicited marketing.
5. Channel partners
Channel/realtor partners may list properties on behalf of owners and must have proper authorization to do so. Partner status may be suspended for policy violations, misrepresentation, or fraudulent activity.
6. Fees
Current use of core buyer/seller features on the Platform is free. Any future fees for premium features, transactions, or partner services will be clearly communicated before they apply.
7. Third-party services
The Platform uses third-party services including Google (Maps/Places/Sign-In), our CRM provider Astrosia, our email provider Brevo, and, where enabled, OpenAI for AI-assisted content. Your use of features backed by these services is also subject to their respective terms.
8. Disclaimers
The Platform, including TrueCost estimates and AI-assisted content, is provided "as is." Valuations and AI outputs are estimates and informational aids only, not professional appraisals, legal advice, or investment advice. You should independently verify all listing and valuation information, including with a qualified professional, before making a transaction decision.
9. Limitation of liability
To the maximum extent permitted by law, 59 Realtors is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform, or from any transaction, dispute, or interaction between users conducted outside our direct control.
10. Termination
We may suspend or terminate accounts that violate these Terms, submit fraudulent listings, or misuse the Platform. You may close your account at any time by contacting us.
11. Changes to these Terms
We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts having jurisdiction over our place of business in India.
